…Commission directs manufacturers, importers and dealers to verify device approvals and IMEI details before sale and distribution

The Nigerian Communications Commission (NCC) has reminded manufacturers, importers, distributors, dealers and retailers of SIM-enabled devices of their statutory and regulatory obligations, as it strengthens compliance monitoring to ensure that communications devices entering and circulating in the Nigerian market meet applicable standards.

The Commission said the enhanced monitoring and enforcement measures build on its earlier announcement on Type Approval compliance and are anchored in the Nigerian Communications Act 2003, the Type Approval Regulations 2024 and the Type Approval Business Rules 2024.

Under the requirements, all device models intended for importation, assembly, distribution or sale in Nigeria must obtain the necessary NCC Type Approval, in line with Section 132 of the Nigerian Communications Act 2003 and Regulation 4 of the Type Approval Regulations 2024.

The Commission also requires Original Equipment Manufacturers (OEMs), Original Device Manufacturers (ODMs), importers and other responsible suppliers to submit the International Mobile Equipment Identity (IMEI) details of individual devices through the approved compliance process for verification before sale and distribution.

In a notice to industry stakeholders, the NCC urged businesses to review their existing inventory and work with their suppliers to address any outstanding Type Approval or device verification requirements. New imports must equally satisfy the applicable requirements before being introduced into the Nigerian market.

The Commission noted that it had undertaken extensive engagements with manufacturers, importers and relevant industry associations as part of its participatory approach to regulation. Businesses that have not participated in these engagements or require clarification on the compliance process were advised to seek guidance through the Commission’s approved onboarding and support channels.

According to the NCC, the automated Type Approval Compliance process is designed to strengthen regulatory oversight of communications devices entering Nigeria and improve the identification of potential irregularities in their importation and distribution.

The initiative will also support collaboration with the Nigeria Customs Service in reconciling import records, promoting compliance with applicable duties and encouraging fair competition among businesses operating in the communications device market.

The Commission warned that, upon full implementation of the enforcement framework, devices that fail to meet the applicable requirements may be restricted from accessing Nigerian mobile telecommunications networks.

The NCC reiterated its commitment to working with industry stakeholders to facilitate compliance, protect consumers and promote a fair and sustainable market for communications devices in Nigeria.
